I am pleased to advise you that the Complaint Tribunal assigned to the E J Russell matter we tried in Canton a few months back found that E J Russell should be suspended for ten months for her misconduct regarding the handling of your matters. Ms. Russell could appeal the decision, but I do not foresee that happening as I do not believe she can afford to pay the costs of the appeal. The Bar is not interested in appealing the decision because she will have to apply for reinstatement and demonstrate she has made restitution to each of you - a feat we do not see as being possible.
This is about as good a result as one can reasonably expect. Of course, it does not correct what she did to you and your individual cases. I will remind each of you that the disciplinary process is limited in what it can accomplish. The Bar is charged with limiting future misconduct. We, unfortunately, are not able to get money damages for you individually. The best analogy is that we are like the district attorney's office that prosecutes a criminal. The district attorney can bring charges that will put the criminal in jail, but he or she cannot get money damages for the pain and suffering you experienced as a result of the crime committed.
Nevertheless, I hope you are as pleased with the result as we are. I do not foresee a situation where Ms. Russell will ever practice law again and will be able to do the damage to others as she has done to you. A copy of the order of suspension is attached for your review.
